不向人民犯罪，美国电邮服务商情愿关闭

　　总部设在美国的德克萨斯州的加密电邮服务网站Lavabit所有人莱文森（Ladar Levison）周四（8月8日）在官方网站中发表声明称："我被迫要做出一个艰难的决定：是成为对美国人民犯罪的同谋，还是关闭用近10年的辛苦工作才 建立起来的Lavabit。"

　　无独有偶

美国司法部对此尚未置评。周四，在Lavabit被迫关闭之后，一家以安全通信服务闻名的供应商Slient Circle公司也关闭了其邮箱业务。该公司创始人之一卡拉斯（Jon Callas）在推特和公司所属的博客上发布了这一消息。

卡拉斯在博客中对用户写道，"我们看到事态的走向，所以我们决定现在最好还是关闭邮件服务。目前我们尚未收到来自任何一个国家政府发出的传票、授权令、安全信函或者其他东西，这是我们选择现在就行动的原因。"

卡拉斯还写道，Silent Circle公司将会继续提供安全短信和安全语音通话服务，电邮则很难真正保障隐私。他和公司的其他领导没有立即回应记者的采访请求。

据提供新闻资讯的《全球邮报》网站（GlobalPost.com）报道，在四周前莫斯科的新闻发布会上，一位人权观察的代表称斯诺登与其联系的邮箱网址来自Lavabit。

普通用户一般不会使用有效加密功能。一些由斯诺登揭秘的文件表明，谷歌、微软及其他大型供应商被迫帮助情报机构收集用户的邮件和其他信息。许多大型供应商和公司特别提供加密服务，但是也表示它们会配合包括情报机构等部门提出的合法请求。

非同寻常

Lavabit相对特立独行，因为该公司表示在他们服务器上被加密的邮件，只有通过用户的密码才能登陆。Lavabit的声明暗示，他们收到了禁言 令。 相关律师指出，除此禁令之外，恐怕还附加有让该公司提供信息的要求。美国政府可能正在寻找未加密的斯诺登电子邮件通讯信息，以及关于他的其它信息。此举意 在破译出斯诺登以后的邮件，或是Lavabit数十万用户的邮件内容或基本资料。

电子自由基金会（Electronic Freedom Foundation）的律师奥普萨尔（Kurt Opsahl）表示，一家合法的美国公司关闭服务，而不是配合政府的信息要求，这是一件罕见且史无前例的事。"这确实非同寻常，" 奥普萨尔强调，"我还没有听说在这种情况下会有公司选择关闭服务。"

据莱文森称，Lavabit已开始准备在第四巡回上诉法庭为其辩护的法律文书。曾为维基解密效力的律师雷特纳（Michael Ratner）表示，"所有的这些告诉我们一个教训：我们在互联网上所做的一切几乎都会被政府监控。"

Lavabit Statement:

My Fellow Users,

I have been forced to make a difficult decision: to become complicit in crimes against the American people or walk away from nearly ten years of hard work by shutting down Lavabit. After significant soul searching, I have decided to suspend operations. I wish that I could legally share with you the events that led to my decision. I cannot. I feel you deserve to know what’s going on--the first amendment is supposed to guarantee me the freedom to speak out in situations like this. Unfortunately, Congress has passed laws that say otherwise. As things currently stand, I cannot share my experiences over the last six weeks, even though I have twice made the appropriate requests.

What’s going to happen now? We’ve already started preparing the paperwork needed to continue to fight for the Constitution in the Fourth Circuit Court of Appeals. A favorable decision would allow me resurrect Lavabit as an American company.

This experience has taught me one very important lesson: without congressional action or a strong judicial precedent, I would _strongly_ recommend against anyone trusting their private data to a company with physical ties to the United States.
